Abstract

The purpose of this paper is to present the Land Swap property acquisition modality as a safe and effective way for Real Estate Developments in accordance with Federal Law 4,591 / 64, created from the preliminary project of Professor Caio Mário Pereira da Silva. and that also governs the condominiums. The demand for housing in the country has caused the verticalization of increasingly necessary housing developments and large developers, through land swap, manage to implement large projects contributing to reduce the still large housing deficit. However, with the economic instability of the country, it is impracticable to maintain a land bank of its own land by immobilizing the capital, so the exchange of land for real estate development projects has become a reality and a way to reduce and share the risk of possible failures. But how to generate legal certainty for such projects? This paper will be presented through the descriptive / explanatory methodology through theoretical references, in particular bibliographic research, jurisprudence, specialized journals, internet articles, how to make this business safe especially for the landowner since it is a “sine qua'' situation. non” the success of the venture to pay the land.
