Abstract

Adoption is an institute included in the Brazilian legal system with the purpose of enabling family formation, similar to the natural family, in which all the rights of the adopted children are transferred to the biological parents as members of the adopting family, granting the child/adolescent all the family rights. It is a legal act in the strict and complex sense because it depends on judicial decisions to be effective and supported by the law. The Statute of the Child and Adolescent (ECA) guarantees adoptees to find their well-being and defend their best interests so that they are raised by a family that provides them with a healthy and balanced environment, where they can grow physically, mentally, emotionally and intellectually. Therefore, it is understandable that adoption is an essential legal procedure, both for the adopter and for the adopted, enabling them to obtain an adequate family structure. In view of the above, this research aimed to analyze the various aspects of the adoption of children and adolescents with physical disabilities, from the perspective of the dignity of the human person, emphasizing the particularities, motivations and limitations, addressing several characteristics and bringing a demonstrative analysis of the points more important.
