Abstract

This article describes the main legal issues surrounding organ donation, define concepts essential to the understanding of the issue and its implications in the Brazilian legal system. Organ donation despite all its altruistic appeal in practice reveals a controversial issue, namely the freedom to dispose of the body, so the issue is very sensitive and deserves greater attention from legal scholars. To achieve this level, it is used as a mark theoretical the Manual de Biodireito of the authors Maria de Fatima Freire de Sá and Bruno Torquato de Oliveira Naves and uses the focus method of dialectical inquiry in contrast to the ideas through a review of the literature, case law collection and analysis of the content of the legal arguments.
