E-commerce and alternative forms of conflict resolution in the consumer protection code from the perspective of civil liability of intermediation sites

Abstract

This article presents an analytical approach on electronic commerce and alternative forms of conflict resolution in the Consumer Protection Code from the perspective of civil liability of the intermediation sites. It is evident that, since the internet became available to Brazilians, commerce is no longer seen simply as an activity of intermediation between producer and consumer. Current commerce, especially electronic commerce, creates and expands new paths for consumers. The purpose of this analysis is to verify the issue of civil liability of the intermediation sites regarding virtual consumption, and how this is worked out in the Consumer Protection Code, with regard to alternative forms of conflict resolution. In addition, it is necessary to approach the Law that regulates e-commerce, without neglecting the importance that the Consumer Protection Code has for consumer relations. With a glimpse of these issues, the concept and elements that characterize electronic contracts signed in the virtual sphere are initiated. In view of the above, the aim of this study is to make an examination of the consumerist virtual relationships, presenting the possible existing solutions so far, about the alternative forms of conflict resolution adopted in the scope of Consumer Law from the perspective of civil liability. of the intermediary sites, such as the judicial centers for consensual conflict resolution and citizenship, better known as Cejusc.
