Abstract

This article aimed to analyze the appropriate procedural moment for establishing
compensatory alimony within the current Brazilian system of law, considering cases of
economic imbalance affecting women due to divorce. The study is based on doctrines of
Brazilian Civil Law and Family Law, as well as an analysis of the Gender Perspective Judgment Protocol of the National Council of Justice (CNJ in Portuguese). The research aims to reflect on the practical applicability of this Protocol, which was created as a public policy measure to combat gender inequality. The effective implementation of the Protocol is necessary to promote women's empowerment and the fight for women's rights.
