Abstract

The scope of this article, in view of today's family profile, comprises the use of contracts in the exercise of private autonomy of the components of the family entity, especially the polyaffective family, given the lack of recognition of this in the legal system, in order to guarantee the dignity of the human person and the eudaemonistic character of Family Law. For this purpose, documentary research was carried out, based on articles, books and court decisions. Consequently, the result of this research demonstrated that it is possible to use contracts as a way of guaranteeing the rights of members of the polyaffective family, with state intervention being authorized only in exclusive cases.
