Os conflitos entre o Código de Defesa do Consumidor e os contratos de alienação fiduciária de bens imóveis

Abstract

Brazilian legislator in seeking to increase investment and ensure security in real estate transactions, edit innovated by Law 9514 of November 20, 1997, by which it established in the legal mother a new type of guarantee for loans and financing, known as alienation fiduciary of goods estate. The aim of this paper is to analyze and verify the applicability of that institute, in the face of standards of the Code of Consumer Protection, as well as draw parallels and point out the solution possible to apparent conflict of rules listed in the two law enactments.
