Abstract

This article aims to explain the illegality of evidence produced as a result of police activity, since the production of evidence is extremely important in investigations, as it provides objective and reliable information to establish the facts, corroboration reporting, support decision-making, promote justice and contribute to the advancement of knowledge. However, these cases are illegal or illicit, cannot be taken into consideration, and must be removed from the process. At the end of the work, it can be concluded that the incorporation of the judgment of guarantees aims to eliminate the interruptions of the illegalities of the evidence in order to bring greater reliability to the Brazilian legal system. The methodology used was qualitative.
