Abstract

In the global pandemic scenario, which ravages the world and amid the numerous political, economic, social and juridic controversies whose this context brings with it, the present study aims to build a legal analysis about the discussion on the obligatory vaccination for all Brazilian citizens. Its goal to examine the constitutionals rights to life and to personal freedom, those which centers the discussions. These juridic debates revolves around the scientific fact of the individual immunization from the vaccine generate an impact in the collective health and lows the transmission rates of the plague. The methodology of this work is research bibliographical research on its subjects. The text discourse begins with a brief explanation on the emergence of the epidemic disease and its coming to Brazil; continues with the historical marks of public vaccination on the country and its pasts and presents acceptance divergences, discoursing legal aspects about these subjects, extolling the analysis of the rights to life and to individual liberty. Thus, reaching the conclusion that facing the very harmful SARS-COV-2 pandemic, an important ally in combating this disease is mass vaccination and it is necessary to weigh up constitutional principles, because of the principle of proportionality, defending compulsory vaccination of the entire population, bringing reasonable sanctions to those who refuse to be immunized.
