Abstract

This study aims to analyze the legitimacy of the dog use in the search and capture of fugitive offenders, as well as the importance of this as a tool of lower offensive potential, which always will objective the least harm to the person who will receive the power of State. The document also addresses what is the use of state force, its general aspects and its guiding principles, in order to understand the use of the dog as the use of state force. Moreover, will be explained the excludent the illegality existing in the Brazilian legal system, that is present in the conduct of public servant, this shall not be liable for any damage suffered by the offender. It will also be addressed state responsibility when situations occur that will not be considered exclusive of illegality, this responsibility may be civil or criminal, also being analyzed state return action in the face of causing the damage agent. Finally, will be analyzed the dog use in Public Security as an essential working tool for the activities performed by this sector.
