Obstetric violence is a serious violation of human rights and public health, gaining attention in discussions on birth humanization in Brazil. This study examines the historical and social development of movements that expose abusive practices against birthing women, emphasizing women’s autonomy in childbirth and reproductive rights. The research addresses the lack of specific legislation and rights awareness, identifying how these factors impact the prevention and accountability of such practices. Utilizing a qualitative, exploratory, and descriptive methodology, the study is organized into chapters that explore the emergence of obstetric violence in Brazil, women's rights to a humanized birth, the absence of specific legislation, and the legal challenges in holding health professionals accountable. It concludes that raising awareness and strengthening women's rights, alongside structural and legislative changes, are essential to combating obstetric violence
