Abstract

This is an article referring to abuses of authority committed by public agents of municipalities, states or the Union, moved by all those who claim to be at the service of the citizen, when in fact they go beyond the fundamental guarantees of citizenship enshrined in CF/88, causing constraints not provided for in the legislation, and as a consequence of this unfortunate attitude, the responsibility of the State and compensation to the victims. It will also be the evolution of the legislation regarding the crime of abuse of authority, until the current law, law 13.869/19, and also, according to the punishments provided for therein. In conclusion, that the abuse of authority is nothing more than the illusion of the agent in thinking that providing a service to the state makes him greater than society.
