Abstract

The present work aims to make a critical analysis of the need for §5 of Article 157 of the CPP, for eventual breach of the impartiality of the judge who has contact with illicit evidence. This rule was introduced by Law 13.964/19 and there is a legal discussion about its influence on the formation of the judge's conviction. In the end, it can be concluded that the aforementioned rule is not necessary, since the judge who comes to have access to illicit evidence does not necessarily lose his exemption.
