The crime of infanticide is established in article 123 of the Brazilian Penal Code, whose objective type is the mother killing your own child, during or shortly after delivery, influenced by the puerperal state. The study developed in this article aims to evaluate the existence of an incon gruity in the legal treatment between the crimes of infanticide and the crime of abortion, when, in this crime, the woman can be submitted to the same influences or side effects of the puerperal state.
