Brief analysis of its constitutionality

Abstract

This article has as a main purpose to discuss possible controversies between the Rome
Statute, the international treaty establishing the International Criminal Court and the Constitution
of the Federative Republic of Brazil. To this end, it will be approached article 5, paragraph 4, of
the Brazilian Federal Constitution, plus Constitutional Amendment No. 45 of 2004, which deals
with the submission of Brazil to the jurisdiction of the International Criminal Court and it will
be discussed the institutes of surrender and life imprisonment. Theoretical-bibliographic research
will be carried out, developed in doctrines on Human Rights and International Law and articles
published in legal journals. The methodological procedure will delimit the theoretical problem,
adopting the deductive method.
