Abstract

Law No. 12.850, of 2 August 2013, brought significant contribution to the Brazilian legal system, especially the improvement of the concept of criminal organization, which finally became an autonomous crime in Brazil. On the other hand, the Law disciplined over the means of evidence as the award-winning collaboration, controlled action and infiltration agents, subject object of this monograph in order to support the police and the Public Ministry of evidence to f ind out and punish members of criminal organizations. In this context, the present study has as main objective the analysis of the undercover agent in Law No. 12,850 / 13, especially when the infiltration agent comes to practice any crime, discussing the limits of the crimes committed by the undercover agent. For this, we use the deductive research method, referring to doctrine and relevant legislation.
