Abstract

This paper aims to outline the legal parameters of the possibility of homosexuals require assisted reproduction techniques as a social right, including the right to health and family constitution for the sake of human dignity. Therefore, there will be a study of cases between Brazil and Portugal heterologous reproduction as a solution to homoparenthood and an analysis of the Portuguese Constitution and the Brazilian Constitution.
