Brazil encounters difficulties with regard to systematize, develop and solidify its property market, particularly within the housing. Able to find ways to maximize security and return on investment is crucial for the growth and strengthening of the housing market. Well, it is clear the importance of this market, and ultimately, its impact on the States economy as a whole. The need to establish mechanisms, in particular, laws that guarantee a return to the investor, or rather a quick fix that will sustain if the default is a global trend. In seeking to balance this scale, increasing investment and guaranteed security to investors, the Brazilian legislature has innovated to edit the Law 9514 of 20 November 1997. Creating the native legal system a new type of loan guarantees and financing, known as Alienação Fiduciária de Bens Imóveis. The aim of this study is to is to analyze the institution of Alienação Fiduciária de Bens imóveis and its effect on the constitutional command of access to housing.
