Uma crítica às súmulas vinculantes a partir de Hans Kelsen

Abstract

This essay questions the current belief of the possibility to render uniform by summary binding. It argues that’s not possible to intend that a summary solves the “problem” of judicial interpretation of law. To demonstrate, it uses the deficiencies already shown by Kelsen to the classic positivism and this perception about the “set of possible interpretations”.
