It analyzes the need for regulatory frameworks that balance technological innovation with the protection of fundamental rights, such as human dignity, privacy, and due process. The main challenges of this integration are addressed, including transparency, civil liability, personal data protection, and algorithmic governance. Emphasis is placed on ensuring that automated decisions are subject to human review, guaranteeing the right to adversarial proceedings and full defense. The study highlights the importance of developing a robust and adaptable normative model so that artificial intelligence can be used as a legitimate tool to promote justice, citizenship, and democracy within the legal system. Therefore, it aims to contribute to the ongoing debate on the ethical, legal, and social aspects of AI regulation in Brazil.
