Abstract

This work aimed to present a study on the indispensability of the rule of article 158 of the Brazilian criminal procedure code. It will be discussed in the course of the research on the importance of the expertise and the preparation of the expert report when the infraction leaves traces, enabling a better judgment and rationalization of the judge in the face of the facts that have occurred, and the report can be made directly or indirectly, correlated with the criminal a constitution of facts. As far as the object is concerned, criminalistics is translated into all traces, everything that is found at the crime scene, being studied and interpreted by the experts, can be transformed into evidence applying the principle of contradictory and broad defense of the accused. Finally, the study provided a critical view of the examination of the body of crime as an essential tool in the search for legal truth.
