Abstract

The present work refers to the analysis of the management of evidence within the scope of the Brazilian Criminal Procedure Code, in particular the possibility of the production of official evidence by the judge before the accusatory system. It was possible to conclude that the management of evidence in the Brazilian criminal process is up to the parties. The study methodology used was the bibliographic review, referring to the renowned doctrine on the subject, in addition to Jurisprudence. As for the reasoning method, deduction was used, carrying out theoretical research, with legal support from a constitutional approach from the perspective of a democratic process.
