Aposentadoria especial em atividades no setor elétrico

Abstract

This work presents the legal and technical aspects that involve special electricity retirement. Its objective was to elucidate the appropriateness of this benefit, its historicity and legality, emphasizing the way in which the Brazilian judiciary treated the theme throughout its existence and its real need for workers who are exposed to this dangerous agent. A study of laws, doctrines, jurisprudence, scientific studies, opinions of workers' unions in the area, entities that study the theme and experiences of workers in an electric utility was carried out. The results showed that there is a real need to maintain the special retirement, because, as thought by the legislator when creating this institute, the worker must spend as little time as possible exposed to such risk, using the maximum of his work capacity during the minimum possible time, since all Individual and Collective Protection Equipment, even though they mitigate the risk involved in the activity, are not able to extinguish it. As will be demonstrated at the end of this work, electricity is a factor that puts the worker's life at risk.
