Abstract

This article focuses on the effectiveness of the parental alienation law in practice, aiming to analyze whether law 12,318/2010, in itself, is effective in inhibiting parental alienation, as well as presenting alternative methods to achieve this purpose. The methodological approach adopted in this article is qualitative, seeking to analyze the concepts, ideas and understandings about parental alienation as well as the applicability of public policies to curb it. It is known that parental alienation is a real phenomenon and that the number of cases in the Brazilian judiciary has been growing exponentially, hence the importance of debating ways to undermine this practice within Brazilian families. As a result of the studies carried out for this article, it was concluded that Law 12.318/2010 is unable to fulfill its fundamental role in inhibiting parental alienation, making it necessary to create other public policies to achieve this objective.
