Abstract

The present research aims to analyze the possibility of granting custody of pets at the time of the litigious breach of conjugality and, in the possibility, to verify if the regime of application of the referred guard will take place with the use of analogy to the child custody institute provided for in the country's Family Law, in the light of of the Brazilian legal system, which, despite the lack of express regulation regarding the custody of domestic animals, there is a need for its regulation, since this fact is increasingly present in Brazilian families, generating effects not only in the personal sphere but also in the civil sphere. For that, the The research methodology used for such analysis consisted of both the deductive, as for dialectics. The means used to collect information were based on in bibliographic review, jurisprudential examination about the research object, as well as as well as the analysis of bills and current national legislation. Based on research carried out, it was possible to conclude the possibility of applying the guard of animals of pet in a similar way to the custody of the children on the occasion of the litigious dissolution of conjugality, although there is still a contrary understanding, which opts for apply what is still positive in the current legal system, in the sense of framing the pets in the list of goods to be shared.
