Abstract

This is a literature review that aims to bring a possessory analysis between the institutes of Brazil and Paraguay, in addition to providing a study on subjective and objective theories of possession, and bring a comparison between the Latin American reality that, despite to adopt doctrinally objective and subjective theories, its laws bears no loyalty to institutions, so that the ordinary laws make a real juggling act to bring an adaptation to the reality of each country, without taking a doctrinal position that in the American countries theories are themselves and are not effectively used.
