Abstract

This work aims to address a new perception of the prison system, which points out the errors in prison management that cause recurrent problems. The article will deal with the sanitary and structural aspects of prisons. Throughout the work, a comparison was made between the constitutional principle in art 5 of the Federal Constitution of 1988 and the true reality of inmates. In addition, the disrespect and lack of commitment of the prison system managers was analyzed, which entails several other problems, such as the increase in the degree of recidivism that, consequently, generates overcrowding of prisons. These problems are cumulative and gradual, where, through one problem, countless others arise.
