Abstract

The present study aims to analyze the incommunicability of the judgment council of the Brazilian Jury Court from the perspective of the principles listed in the Federal Constitution, in order to meet the aspirations of society and effectively institute democracy in that jurisdictional body. . Therefore, it is intended to cover the historical context of the Jury Court, as well as to analyze its guiding principles established by the Constitution of the Federative Republic, which has democracy as its form of government. The constitutional principles are guarantees expressed in the Magna Carta and must be observed in all their essence, as a whole, during the entire procedure of the Jury Court, since it is a fundamental guarantee of the human person. Justice must be the main objective of the State and society and must be pursued by all. It is concluded at the end of this work that the institution of the Jury Court is of extreme relevance for the Democratic State of Law, but the principle of democracy in its entirety must be integrated into it, attributing to the people the effective popular sovereignty.
