Inviolability of the domicilious and military police rights

Abstract

The violation of domicile is a situation that demands to the agents of public security an intimate knowledge of the applicable norms, since they can impact in the success or failure of the diverse actions or operations triggered with the purpose of fulfilling judicial order or repressing crimes and contraventions. The analysis of the military police action, based on the philosophy of Human Rights, concerning the right to privacy is constitutionally protected and by international diplomas - in addition to PMMG standards - and is directed towards the extinction of the common practice of violation of domicile perpetrated by public officials. For this purpose, a methodology was used to read specialized texts on the subject, as well as research on the decisions of the national courts. The research results from a bibliographical and documentary review.
