This article was prepared with the help of bibliographic research, specialized magazines, and Internet articles. It has aimed to examine whether the National Council of Justice is competent to create resolutions regulating the eletronic jucidial process. To achieve this objective was necessary to study the competence of that organ and the definitions of what is a resolution and what is law and what each can reach, and only then talk about the creation of PJE and what laws or rule regulate these new judicial procedures. Through these clarifications, it was possible to establish the base theme, demonstrating which is the competence of the organ in comment.
