Abstract

This study aims to analyze the main paradigmatic changes experienced by the Institute of Civil Liability since its approach by the French Civil Code of 1804, as well as pointing out the important pre-paradigmatic scenario that has been appearing in the Brazilian Law studies with the proposition and recognition of new categories of compensable damage, especially the existential damage, that is related to the violation of attributes of human existence. In this spectrum, the anal ysis will also be studying the ‘temporal damage’ in consumer relations, especially the waste time that consumer face which is imposed by the disruption, failure or negligence of suppliers of goods and services.
