Epistemological contributions of the economic analysis in business law

Abstract

The present article aims to address the epistemological contributions of economic analysis in Business Law, according to the perspectives brought by Karl Raymund Popper and Thomas Kuhn. On the one hand the law is understood as a set of rules governing the behavior (duties and powers) of people or phenomena with legal attributes and the standard of non compliance (rules and principles) is a State sanction or intermediate groups, economic analysis is concerned to address the behavior of human beings and phenomena related to excess or shortage of resources and the consequences of decisions taken. The Corporate Law, in turn, constitutes a set of legal rules governing private economic activities implemented with scope to produce circular or goods or services intended for the market. Based on these conceptual frameworks and without pretending to exhaust the topic is investigated, the effects of set of business law standards on human behavior and the legal phenomena from an economic analysis and contributions that can offer to that, according to the paradigms of fallibility (conjectures and refutations) Karl Raymund Popper and Thomas Kuhn epistemological proposal of pre-paradigmatic stage, paradigm, the paradigm crisis and the scientific revolution.
