Abstract

This scientific issue deals with excess procedural prison, when seeking consistent doctrines and jurisprudences to the topic title. It is a subject little explored in Criminal Law and raises great upheaval in Brazilian society, due to legal constraints by which citizens are affected by excess prison. The rehabilitation of the roads would be more relevant to the disciplinary training, with a view to invest in the human being is to invest in recovery and social citizenship in a democratic state of law. This thought is processing the conjunction of human rights, puman dignity in any environment and the Constitution of the Federative Republic of Brazil.
