Abstract

The constant search for the existing relation between Moral and Law has been since the beginnings, one of the issues most addressed by the scholars of the Legal Philosophy. Thedifficulty in visualizing a Law apart from the moral sphere, has often led us to the false certainty of that all Legal Rule brings in its essence, a Moral Precept. Tracing a parallel between the two terms, and the effect of each of them on the human action, seeks for a better definition and conceptual differentiation, emphasizing the technical nature of the Law, which tends to become clearer and objective the scope and characteristic of each one of the spheres, which undoubtedly have particular and differentiated characteristics.

Célia Regina Fonseca

Doutoranda em Direito Penal pela UBA - Universidade Buenos Aires, na Argentina. Pós-graduada em Direito Público pela Faculdade de Direito de Ipatinga. Graduada em Direito pela Universidade Federal de Minas Gerais – UFMG. Atuou na Advocacia nas esferas Criminal, Cível e Trabalhista, em Belo  Horizonte - Minas Gerais e em Sorocaba - São Paulo - (Escritório Imar Eduardo Rodrigues e Advogados Associados, onde prestou serviços a diversos Sindicatos, em especial ao Sindicato dos Metalúrgicos de Sorocaba e Região). Atualmente leciona matérias das áreas Penal (Penal III), Cível (Teoria Geral do Direito Privado, Civil I - Obrigações) e Hermenêutica  pela Faculdade Minas Gerais - FAMIG, em Belo Horizonte, MG. Assessora Jurídica da Câmara Municipal de Belo Horizonte, onde atua na área legislativa.
